fark :cry: i got a $192 fine, and the cop said it was 3 demerits, then he checked his book and said "tell a lie, its no demerits", does any1 in SA know?? ive got my fingers crossed cos ive only got 2 left :oops: :(

yeah true! its not so much the fine thats harsh its the 3 fkn demerits... i thought afterwards i shoulda said i was using my hand-held UHF, cos that doesnt seem to be illegal :twisted: grumble grumble

im *fairly sure they just bought a new law in which means you loose 3 demerit points...
i bet you will get notification in the mail... grrrr
I hope this new law hasnt been implimented yet

Yep......I think it used to be $90 something without any demerit point before the new law. If they fine you $192 for sure there're gonna be 3 points......
You should get a phone with speakerphone......or use a handsfree......

my mobile has a speakerphone, and i hav a handsfree... i really dont hav any excuse, but it was a 10sec call.. its fairly b/s tho cos u can talk on a UHF, smoke, play with ur stereo, talk to a passenger........ i mean come onnnnnnnnn wtf is up with 3 demerits! lol

Im pretty sure, but not 100% sure, that talking on any UHF, be it hand held or car mounted, is illegal. Its no different to a mobile phone by law.
I think the 3 demerits is taking things a little far. Ok, its taking things way too far....

Too far....... hmmm... well it has certainly deterred you hasn't it so it's done it's job. 3 points is better than having a crash cos you weren't paying attention and its not like it a new law they just put in.

I'll have to ask my bro about the CB thing, i was pretty sure from memory that a CB was ok for some reason?
EDIT: Just confirmed... it is ok to talk on a CB radio while driving, it is only illegal to talk on a mobile phone (in Vic).

If i ever get pulled over for talking on a mobile phone, the 3 demerit points are the least of my worries.
Officer: Excuse me Sir, but how were you steering the vehicle?
Me: Well Sir, you see i put the phone to my ear, then let my legs do the driving :lol:
Least they cant hand cuff me ;-)

I feel the 3 demerit points is a perfectly valid punishment sorry dude, as think about all the fukin ditzes out there who talk on the phone and fail to pay attention to their driving and weave all over the road, I for one have had too many close encounters with these people.. I figure any discouragement towards them is a good thing ! :/

Exactly my point, i've seen people hit gutters, run stop signs and run people off the road while talking on phones.... as if there weren't enough idiots on the road to watch out for without people on mobile phones!

i mean i know it is distracting but so are a lot of other things, i think there is a point to where it should be stopped, like pull the person ova IF they were dangerous driving...

Having all said that, i have mastered the art of no armed driving whilst being in the middle of a threeway conversation the involves me, the person on the other end of the phone and my passenger.
But seriously, you say it deters people from doing it, looking on the roads at the moment, id say thats not the case. Theres more people talking on phones than there is people speeding.
Dezza, Im sposed to have one on my car, but the soob doesnt need one. I do have one on the Jeep tho, cause even a bi-armed warrior couldnt get that thing pointing in the right direction without it. I did get warned by the plod for not using one, but i b/s my way out of it. And dont feel for me, i get by just fine as i am....

That just means that at that second they were going in a straight line, half a second later they might be head on into traffic or a pole. I realise you point that lots of other things are distracting, nd a handsfree isn't much better as the overseas studies showed but holding the phone is the only one they can police effectively. You can always appeal it in court anyway if it comes down to you losing your license, or you can go on a probationary period for 12 months where you only have one point but if you get caught doing anything you lose your license for 6 months instead of 1. Or you can give up your license for 3 months and get all your points back. Don't be tempted to drive without a license though cos if they catch you you'll get reamed! Plus it makes for the most stressful experience of your life....ummmmm... so i'm told :? :lol:

txting on a phone is easy, im not saying thats for everyone because most people dont know where the buttons are, the fun starts when your using a PDA to write sms :shock: ive tried it, and its just dumb

Now txting at night is great fun, just dont look at the screen too much. Thats when it goes pear shaped.
I've actually found myself pulling over of late cause i cbf talking while im driving anyway... ahh responsibility, isnt it great???

tbh testing is taking your eyes, as well as your concentration away from the road, rather than just talking, which can be easily done with relatively little concentration; as well as still watching the road.

i hope you dont lose your license dezza but this is really one of my pet hates. its amazing how many people you see hootin down the freeway with a mobile stuck to their ear. they always seem to hold up the fast lane too.....which is probably what pisses me off in the first place :evil:
quit making excuses and get a hands free kit......theyre cheaper than the fine you cop :wink:

have u ever been on ur mobile while driving and gone thru and intersection and mins later gone to ur self.... "hmmm was that light green?" :shocked:
It really does hamper your judgment whilst driving...
As others have said i cant stand it when u see some biatch of a mother in her toorak tractor on the phone more worried about what dress she is going to buy from Gucci on chapel than the car next to her that she is about to force into oncoming traffic.... and the worst bit, she would keep driving not having any clue what she has just done!
Its not just women tho.... just an example ;)

Actually guys, the problem is not that you're HOLDING the phone. It's that your ATTENTION is divided. Studies have shown that your reaction time when talking on the phone is similar to driving drunk, because you're not paying attention.
So to be honest, I think its a fair call, and also that the same fine SHOULD apply to all those other things which distract you. The thing with mobile phones is that everyone has them now, whereas UHF isn't anywhere near as popular. I'd also say that the average mobile phone user would have far less of a clue than the average UHF user.
As far as smoking and talking to passengers is concerned, they're just as dangerous as talking on a phone, and I personally reckon police should be able to fine you at least for smoking. I'm sure people hate driving with me, because I rarely listen to what they're saying, because I'm concentrating on the road.
The difference between driving safely and killing someone can be a few seconds lapsed concentration! I was behind a guy in a Gemini a few months back who was cruising along in a 60 zone, then I think he seemed to be reaching into the back of the car (it turned out he had a 3 week old baby in there) and 5 second later he hit a telegraph pole!! :shock:
Luckily nobody was killed, but there was some serious injuries and a written off car.
So as much as it sucks to get a fine... It's for your own good in the long run!

since smoking whilst driving isnt illegal how are the police going to fine people.
not to mention i think there are far better ways to spend tax payers money than having police puller over 1 in 4 people for smoking whilst driving!

ahhh well im over the fine, dont mind about that at all, just really annoyed about 3 demerits.. as for driving along and finding myself drifting over the road, ive found it a lot more worse fiddling with my deck than talking on my phone!
so are they gonna make stereos in cars illegal now? hehe :lol:

Stereo controls on the steering wheel should be mandatory I reckon. They'd prevent as many accidents as ABS!
It's a big thing I noticed when I got the WRX, compared to my Vectra.

If your really concerned with the points why dont you take it to court and explain your case? Worked with me the first time, they still made me pay the fine but took one point off instead of three. The other option is to ask for a deferment. Not sure what it is in your state, but in the ACT they can give you a max period of 180 day, in which time you may have some of your original points back to play with :wink:

i think i can apply for 1 back for a 1 year good behaviour thingo so yeah, hopefully be able to do that..

nah just unlucky, got through my P plate years with no fines! :) was pleased with that, started driving more "sensibly" then started getting fines everytime i decided to speed a bit... :( last one was late at nite down in the country near where i liv by an SS cop who was comin back from an accident... silly of me, but still unlucky..

was at the rego joint today, and they said that i prolly wouldnt b able to get it if i had lost all my points in a 3 year period, i didnt really understand wat he said but has anyone heard something to this affect?

WHATEVER YOU DECIDE TO DO, I HAVE FOUND THAT IF YOU GO TO COURT IN PERSON AND PLEAD YOUR CASE FOR ANYTHING TO DO WITH DRIVING MATTERS, IT WILL ALMOST BE HALVED (WITHIN REASON OF CRIME). MAYBE MY LUCK BUT IF I JUST PAID THE FINE I WOULD HAVE NO LICENCE NOW. 8)

so do u go to the court with ur peice of "fine" paper before you pay it, and then plead wat exactly?
-that you need your licence for work / study commitments or
-that you know you have done something wrong and would like another chance or
-that you dont think you were wrong and shouldnt have got the fine
also do u need to book a time usually or just go there and ask?

I'm pretty sure it's 3 points in all states. In NSW it's 3 points and $220
